These terms explain what BrixCanvas provides, what you control, and the rules that keep the platform useful and safe.

These Terms of Service form an agreement between you and ProSysTech in the Netherlands, the operator of BrixCanvas. They apply to brixcanvas.com, the dashboard, hosted websites, apps, AI features and related services. By creating an account, purchasing a plan or using the service, you accept these terms. Information about personal-data processing is in our Privacy Policy.
You must be at least 16, or use BrixCanvas with valid permission and supervision from a parent or legal guardian. If you use BrixCanvas for an organisation, you confirm that you may bind that organisation. “You” then includes that organisation.
2. The service and beta
BrixCanvas lets you create, edit, preview, publish and host websites using templates, Brix, apps and AI-assisted tools. Features depend on your plan and may include custom domains, commerce, forms, bookings, memberships, analytics, storage and collaboration.
The service is in active beta. We test releases and take reasonable care, but beta features may contain defects, change quickly or be withdrawn. A beta label does not remove your mandatory legal rights. Feedback is welcome through the dashboard and helps us improve the product.
3. Accounts and security
- Provide accurate account information and keep your e-mail address current so you can receive security and service notices.
- Use a unique password, protect security codes and trusted devices, and do not sell, share or transfer your login.
- You are responsible for activity under your account unless it results from a failure that is legally our responsibility.
- Tell us promptly through the security contact form if you suspect unauthorised access.
4. Plans, limits and Free publishing
The current features, prices and limits of Free, Starter and Pro are shown on the Pricing page and in the dashboard. Limits can include websites, custom domains, storage, app availability, AI credits, newsletter delivery and fair-use protections.
On Free and Starter, you can discover, install, configure and preview apps in the editor. App functionality remains blocked for visitors on a publicly hosted Free or Starter site. Pro activates eligible apps publicly, subject to the plan's limits. A downgrade never transfers ownership of your content to us; features above the new limit may be disabled or unpublished until you reduce usage or upgrade.
After e-mail verification, a Free account receives the one-time AI welcome allowance shown on the Pricing page. It does not renew. Starter and Pro allowances renew on their displayed cycle. Credits are charged only when an AI action returns usable output; ordinary technical failures are refunded. We may withhold or withdraw promotional credits where accounts are duplicated, automated or used to circumvent limits.
Fair use excludes automated bulk traffic, scraping, spam, mass mail, resale of platform capacity, crypto workloads and use as general file, proxy or API hosting. Where ordinary growth reaches a limit, we normally offer an upgrade or suitable capacity before restricting service, unless immediate action is needed for security, deliverability, legal compliance or other users' availability.
5. Your content and responsibilities
You keep ownership of content you create or lawfully upload. You grant BrixCanvas and its service providers a worldwide, non-exclusive licence to host, copy, process, adapt for technical display, transmit, back up and publicly display that content only as needed to operate, secure and improve the service or follow your instructions. This licence ends when the content is deleted, except for temporary backups, legal retention and copies made by others while it was public.
You confirm that you have the rights, permissions and lawful basis needed for your content and any personal data you collect. You are responsible for website copy, claims, accessibility, cookie choices, privacy information, consumer information, taxes, licences and compliance that relate to your business or audience.
Public content can be indexed, archived, shared or copied by third parties. Removing it from BrixCanvas cannot remove copies controlled by others.
6. BrixCanvas software and platform rights
BrixCanvas, its software, interface, branding, original templates, Brix, documentation and platform technology remain owned by ProSysTech or its licensors. Your subscription gives you a limited, revocable, non-exclusive, non-transferable right to use them through the service while your account is active. It does not transfer source code, trademarks or platform ownership.
You may use a published website created with BrixCanvas for personal or commercial purposes, subject to your plan. You may not copy, reverse engineer, resell or provide access to the platform itself except where applicable law expressly permits it. Suggestions and feedback may be used without payment or obligation, but we do not claim ownership of your underlying content.
7. AI-assisted features
AI can generate or transform text, layouts and images from your instructions. Output may be inaccurate, incomplete, biased, unsuitable, not unique or similar to material generated for others. You must review output before relying on or publishing it and ensure it does not infringe rights or break the law.
Do not use AI output as a substitute for qualified medical, legal, financial or other professional advice. Do not submit confidential, special-category or unnecessary personal data in prompts. We may apply automated content filters and usage limits, and a provider may process flagged samples for abuse monitoring as described in our Privacy Policy.
Brixie may help analyse a reference website, screenshot or template for general layout, hierarchy, spacing, functionality and design direction. This does not mean the reference or requested result is free of rights. Website elements and their use can be protected by copyright, trademark, design, database, contract, passing-off, unfair-competition or other laws. Brixie is designed not to reproduce third-party text, logos, photography, illustrations, brand identifiers or a recognisably distinctive creative expression, and it will not promise a one-to-one or pixel-perfect copy.
You must have permission for materials you upload or instruct us to use, must review the result for similarity and infringement, and must replace anything you are not entitled to use. A Brixie warning, plan or technical safeguard is not legal clearance and does not transfer responsibility for your instructions or published content to BrixCanvas.
Brixie is limited to approved BrixCanvas guidance, review, drafting and building functions. You must not attempt to extract system instructions, credentials, source code, other users' data or internal infrastructure; bypass safety, plan or authorization controls; or use Brixie to create malware, phishing, exploits, harmful scripts, deceptive interfaces or attacks against BrixCanvas, a customer site or any visitor. We may block an instruction, limit access, preserve security audit metadata or suspend an account when reasonably necessary to prevent abuse or protect the service.
General Brixie chat does not itself change, publish, purchase, delete or configure anything. Building actions require the appropriate site role, an explicit plan and confirmation, sufficient credits where applicable, validated output and a reviewable draft. Automated reviews and scores are practical checks rather than legal, accessibility, security, SEO or professional certification.
8. Apps, customer sites and commerce
If you sell, book, register, enrol, accept donations or otherwise transact through your site, you—not BrixCanvas—are the merchant or service provider. The agreement is between you and your visitor or customer. You are responsible for product accuracy, availability, pricing, taxes, invoices, fulfilment, cancellations, refunds, warranties, customer service and legally required information.
Payments on customer sites use the merchant's connected Stripe account. Funds do not become BrixCanvas revenue merely because the checkout is embedded in our platform. Stripe can reject, hold or reverse payments under its own agreement. BrixCanvas is not responsible for a dispute between a site owner and visitor, although we may provide records or take action where the law or platform safety requires it.
9. Acceptable use
You may not use BrixCanvas to create, publish, facilitate or distribute:
- illegal content or activity, fraud, scams, phishing, impersonation, malware or attempts to compromise systems or accounts;
- child sexual abuse material, sexual exploitation of minors, non-consensual intimate material, trafficking or credible threats of violence;
- unlawful hate, harassment, doxxing, infringement of privacy, intellectual property or other rights;
- spam, deceptive marketing, manipulated reviews, mass-generated junk or communications without required consent;
- content or products whose sale or promotion is prohibited by law or by our infrastructure and payment providers;
- automated access that overloads, probes, circumvents limits, extracts other users' data or interferes with the platform;
- general file storage, malware hosting, open redirects, traffic relays, credential collection or other use unrelated to operating a genuine website.
We may use automated and human review to detect abuse. A report does not automatically prove a violation. We consider context, severity, repetition, law and risk before acting where circumstances allow. Hosted-site abuse can be reported through the report form.
10. Billing, renewal, cancellation and refunds
Monthly and yearly website subscriptions are separate from domain orders. Annual website subscriptions are paid upfront; choosing one does not include a new free-domain entitlement. Existing expressly granted benefits and already accepted domain quotes keep their agreed terms. Account → Billing shows subscription invoices and domain-order invoices made available by Stripe, including download links where an invoice has been issued.
- Paid plans are billed in advance through Stripe at the price, billing interval, currency and tax treatment shown before checkout.
- BrixCanvas offers fixed EUR and USD prices, independently of interface language. Starter costs EUR 9.99 or USD 9.99 per month; Pro costs EUR 19.99 or USD 19.99. Annual payment is twelve monthly prices paid upfront. Applicable taxes are included. These are separate fixed prices, not currency conversions. The currency confirmed at purchase applies to payment, invoices and renewals. Changing your display preference does not convert an existing subscription or domain contract. Your bank may charge currency-conversion fees.
- Subscriptions renew automatically until cancelled. You can cancel online from the dashboard; cancellation takes effect at the end of the current paid period unless mandatory law requires otherwise.
- If payment fails, we may retry, request another payment method, restrict paid features or return the account to Free after reasonable notice. Content is not deleted merely because a payment fails.
- Plan changes and upgrades are charged or credited as shown in the checkout flow. Promotional prices or credits may have separate displayed conditions.
- Fees already paid are non-refundable except where the checkout states otherwise or applicable law requires a refund.
11. Consumer cancellation and withdrawal rights
If you are an EEA consumer purchasing online, you may have a statutory 14-day right to withdraw from a service contract without giving a reason. This is separate from cancelling future renewal. Submit a clear withdrawal request through our withdrawal form before the period expires.
If you expressly request immediate performance during the withdrawal period, the law may allow a proportionate charge for service already supplied. A right of withdrawal can end after a service has been fully performed only where the legal conditions, including required consent and acknowledgement, are met. Nothing in these terms removes non-waivable consumer guarantees, remedies or local protections.
12. Domains, integrations and third parties
See eligible €9.99 / US$9.99 domains and external-domain options on the Pricing page.
Search results may include domains outside our €9.99 / US$9.99 offer. Availability does not mean BrixCanvas sells that domain. Registration depends on the exact name, registry requirements and holder eligibility. Buy excluded names from another provider and connect them here. A domain registration does not include ownership of a trademark or permission to infringe another party's rights.
You are responsible for the right to use a domain or brand and, unless a checkout expressly says otherwise, for domain registration, renewal, DNS, transfer and registrar fees. Connecting a domain does not give BrixCanvas ownership of it and does not guarantee uninterrupted DNS or registrar service.
- Domain orders are fulfilled through Openprovider and the applicable registry. Supply accurate holder details and complete any requested verification. Availability checks do not reserve a name. We submit an order only after confirming the required payment or funded plan benefit.
- Domains are optional on Starter and Pro, with monthly or yearly subscriptions. BrixCanvas only sells eligible domains for €9.99 / US$9.99 including VAT for registration and each one-year renewal, without extra processing fees. BrixCanvas absorbs any shortfall. Eligibility requires non-premium, one-year registrations with both registration and annual renewal supplier prices no more than €20 excluding VAT. .ai, .store, premium names, multi-year registrations and more expensive names are not offered for sale here. New transfers are not offered. Existing paid orders and purchased benefits keep their agreed terms.
- You may buy other domains from an independent provider and connect them to BrixCanvas within your plan limits, without an extra connection fee or a transfer. You contract with and pay that provider directly, under their terms, prices and renewal rules. External links are suggestions, not a guarantee of availability or price. BrixCanvas does not process those purchases or renewals.
- Domain renewals purchased through BrixCanvas are separate from subscription renewal and require your confirmation. Eligible one-year renewals cost €9.99 / US$9.99 including VAT. We never silently charge a higher renewal price. If online renewal is unavailable, contact support before the displayed registrar deadline to arrange renewal or transfer-out options. The registrar deadline may precede registry expiration. A website subscription payment does not renew a domain.
- Transfers require authority over the domain and any required transfer code. They preserve existing registry contacts and nameservers and do not necessarily add a year. New registrations connect the exact address specified in the order; www aliases and mailboxes are not automatically included.
- A payment confirmation is not proof that a registration or transfer completed. We show processing and review states and reconcile uncertain provider outcomes before repeating an operation or refunding it. A confirmed failure before registrar submission is refunded to the original payment method. Contact billing support for other failures or statutory withdrawal requests; registrar non-refundability does not remove mandatory consumer rights.
- Cancelling a website subscription does not transfer or delete a registered domain. Hosting entitlements may end, but domain renewal and transfer arrangements remain separate. Request assistance before deleting an account or website with an active domain.
Third-party services such as Stripe, analytics, advertising, embeds, fonts, webhooks and domain providers have their own terms, availability and privacy practices. You choose whether to connect them and are responsible for a suitable configuration. We may disable an integration that creates a security, legal or operational risk.
13. Privacy and customer data processing
Our Privacy Policy explains how we process account and platform data. Where you use BrixCanvas to collect personal data from visitors and BrixCanvas acts as your processor under the GDPR, the following data-processing terms apply:
- Subject and duration: hosting and operating the features you configure for the duration of your account, plus deletion and backup periods described in the Privacy Policy.
- Nature and purpose: storing, organising, transmitting, securing, backing up and deleting data to deliver the service and follow your documented instructions expressed through platform settings and support requests.
- People and data: site visitors, customers, members and contacts; identifiers, contact details, orders, bookings, submissions, account data and other content they or you provide.
- Our duties: process on documented instructions unless law requires otherwise; ensure authorised personnel are bound by confidentiality; apply appropriate technical and organisational measures; assist reasonably with data-subject requests, security incidents and GDPR obligations; delete or return data at the end of service subject to law; and provide information reasonably needed to demonstrate compliance.
- Subprocessors: you give general written authorisation to use the relevant subprocessors identified in the Privacy Policy. We impose equivalent data-protection obligations and remain responsible for their performance of those obligations. Before adding or replacing a subprocessor, we inform you and give you a reasonable opportunity to object on data-protection grounds. If no workable alternative exists, either party may end the affected service, subject to applicable rights.
- Your duties: give lawful instructions, minimise collection, configure access and consent correctly, respond to your visitors, and avoid special-category or high-risk processing unless expressly supported and lawfully safeguarded.
Each party will notify the other without undue delay when it becomes aware of a relevant personal-data breach and cooperation is reasonably required. Audit requests must be proportionate, protect other customers and confidential systems, and normally use available documentation before an on-site inspection.
As your processor, we notify you without undue delay after becoming aware of a personal-data breach affecting your visitor data; assist with risk assessments, breach notifications and data-subject requests using the information available to us; and inform you if we believe an instruction infringes applicable data-protection law. You may request compliance information and an audit, including an inspection by an authorised independent auditor, with reasonable confidentiality and security safeguards. At the end of processing, you may choose return or deletion of the data unless law requires retention; export before account deletion.
14. Founders and community programme
Founder status is a free, discretionary recognition benefit for genuine contributions. It is not purchased, has no cash value, is personal to the account and cannot be sold, transferred, shared or used to resell platform capacity.
- The benefit normally follows the then-current Pro feature set while the programme exists; plan contents and capacity may evolve.
- When you accept Founder status, your account display name is added to the BrixCanvas Hall of Fame. This recognition is shown only in the hidden Hall of Fame on brixcanvas.com, not on customer sites. We do not add your website unless you separately choose to provide it, and you may ask us to hide or edit the recognition.
- We may revoke it for illegal use, platform or community abuse, dishonest acquisition, manipulated reports, multiple-account abuse, transfer, payment fraud or a serious breach of these terms. The account then normally returns to Free.
- If BrixCanvas is sold, merged, transferred, restructured, discontinued or ends the programme, Founder benefits may change or end. We will provide reasonable notice where circumstances allow; no cash compensation is owed for ending a free benefit.
- XP, levels and leaderboards are recognition features, not currency or a guaranteed entitlement. We may correct or reset them to address errors or abuse.
- Testing, feedback and community participation do not create employment, agency, partnership or a right to payment. You remain responsible for any tax that law applies to a benefit.
15. Availability, maintenance and service changes
We aim to keep BrixCanvas fast, secure and available, but do not promise uninterrupted or error-free operation. Maintenance, provider incidents, internet failures, security events and force-majeure events can affect service. We may change, replace or discontinue features to improve the product, manage risk or comply with law. For a material reduction to a paid core feature, we will provide reasonable notice where possible and any remedy required by law.
We make operational backups, but they are not a substitute for your own records. Use the dashboard export and keep copies of important content, orders and customer information.
16. Suspension, termination and export
You can cancel a subscription or delete your account from Account settings. Deletion is permanent and removes your sites and account data according to the Privacy Policy.
We may restrict a feature, unpublish a site or suspend or end an account when reasonably necessary for an actual or suspected breach, illegal content, security risk, non-payment, provider requirement or harm to users or the service. Where the situation allows, we will explain the reason and give you a chance to correct or appeal it. We may act immediately for urgent safety, legal or security reasons.
Free sites associated with 90 days of account inactivity may be removed after warning. Before planned termination, export your data. After termination, provisions that by their nature should survive—including ownership, payment, liability, dispute and data obligations—continue to apply.
17. Warranties, liability and business indemnity
Everyone
We provide the service with reasonable care and skill. Except for commitments expressly stated here and rights that cannot legally be excluded, BrixCanvas is provided as available and we do not guarantee a particular business result, ranking, revenue, output or uninterrupted availability. Neither party is liable for a failure caused by events beyond its reasonable control.
Consumers
Nothing in these terms excludes or limits mandatory consumer rights or liability that law does not allow us to limit, including liability for intent or deliberate recklessness, death or personal injury caused by negligence, or another non-excludable ground. Any limitation is applied only to the extent permitted by the law that protects you.
Business users
To the maximum extent permitted by law, neither party is liable to the other for indirect or consequential loss, loss of profit, revenue, goodwill, anticipated savings or data. Our aggregate liability arising from the service in any 12-month period is limited to the fees you paid BrixCanvas in that period. This cap does not apply to liability that cannot legally be limited.
If you use BrixCanvas for business, you will defend and indemnify us against a third-party claim arising from your content, products, customer relationship, unlawful instructions or material breach of these terms, to the extent caused by you. We will notify you and allow reasonable control of the defence; you may not settle in a way that admits fault or imposes obligations on us without consent.
18. Changes, notices, law and contact
We may update these terms as the service or law changes. The date above identifies this published version. New orders use the terms and quote shown before purchase; this update does not retrospectively change accepted quotes, paid periods or expressly granted benefits. Material changes to an existing contract require a valid legal or contractual basis and reasonable advance notice, including your applicable right to reject a change or end the affected service. We will notify you by e-mail, dashboard notice or service message; urgent security or legal changes may require faster action. Mandatory consumer rights and any legally required consent always prevail.
Dutch law applies. EEA consumers keep the mandatory protections of their country of residence and may bring a claim in any court available to them under consumer law. Business disputes are submitted to the competent court in the Netherlands. Before formal proceedings, both parties should first try in good faith to resolve the issue through the contact route below.
If one provision is unenforceable, the rest continues. A delay in enforcing a right is not a waiver. You may not transfer this agreement without consent; we may transfer it as part of a merger, restructuring, financing or sale, subject to applicable law and notice requirements.
